By using donaya, creating an account, or making a payment, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.
By using donaya, you confirm that you are at least 18 years old and have the legal capacity to enter into binding agreements.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “User”, “You” and “Your” refers to you, the person accessing this website and accepting the Company's terms and conditions. “donaya”, “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Users and ourselves, or either the User or ourselves.
All terms refer to the offer, acceptance, and payment consideration necessary to provide assistance to the User in the most appropriate manner, whether by formal meetings of a fixed duration or by other means, for the purpose of meeting the User's needs in relation to the Company's stated services/products, in accordance with applicable law, including applicable Spanish law where relevant.
Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

We employ the use of cookies. By using donaya's website you consent to the use of cookies in accordance with donaya's privacy policy. Most of the modern day interactive websites use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate / advertising partners may also use cookies.

Please include your name, your organization name, contact information (such as a phone number and/or email address) as well as the URL of your site, a list of any URLs from which you intend to link to our Web site, and a list of the URL(s) on our site to which you would like to link. Allow 2-3 weeks for a response.
Approved organizations may hyperlink to our Web site as follows:
- By use of our corporate name; or
- By use of the uniform resource locator (Web address) being linked to; or
- By use of any other description of our Web site or material being linked to that makes sense within the context and format of content on the linking party's site.
No use of donaya's logo or other artwork will be allowed for linking absent a trademark license agreement.
Acceptable Use Policy
This Acceptable Use Policy ("Policy") describes permitted and prohibited use of donaya by all users and visitors (collectively, "Users"). This Policy should be read together with the donaya Terms of Service. Failure to comply with this Policy may result in suspension or termination of your access to donaya.
Adherence to Stripe's Restricted Business List
As a user of donaya, you agree to comply with Stripe's Restricted Business List ("RBL"). Stripe is a payment processor for donaya. Any activities listed as restricted or prohibited by Stripe are also prohibited on donaya. The RBL includes, but is not limited to, the sale of (a) illegal products or services, (b) adult content and services, (c) intellectual property infringement, (d) regulated or illegal substances, and (e) high-risk businesses.
Prohibition of Illegal Activities
donaya may not be used to fund illegal activities, including but not limited to:
- Drug trafficking
- Money laundering
- Fraudulent schemes
- Other illegal activities as defined by the laws and regulations of the User's jurisdiction and the laws applicable to donaya, including applicable Spanish law where relevant.
Prohibition of Violent Extremism and Hate Activities
donaya strongly condemns and does not tolerate any form of violent extremism or hate activities. This includes, but is not limited to, the funding or promotion of:
- Terrorism, or activities that promote terrorism.
- Hate crimes, or activities that promote hate crimes.
- Violent extremist groups, or activities that promote such groups.
- Any form of harassment, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, age, sexual orientation, disability, or any other protected status.
Responsible Use
As a User of donaya, you are responsible for all activities that occur under your account. You are required to:
- Use donaya in a manner that is respectful of other Users and third parties.
- Not to use donaya to harass, threaten, defame, or violate the rights of others.
- Not to use donaya to engage in or promote illegal, abusive, or irresponsible behavior.
- Report any violation of this Policy to donaya.
Violations
Violations of this Policy may result in the suspension or termination of your access to donaya. donaya reserves the right to remove any content that violates this Policy and to cooperate with law enforcement authorities and third parties in the investigation of alleged wrongdoing, including disclosing the identity of the User that donaya deems responsible for the wrongdoing.
This Policy is subject to change without notice. Continued use of donaya following changes to this Policy will indicate acceptance of the changes. If you do not agree to this Policy, do not use donaya.
Refund policy
At donaya, we strive to provide our users with the best possible service and experience. We understand that sometimes things don't go as planned, and that you may need to request a refund. Please review our refund policy carefully before making your purchase.
Note:This refund policy applies to donaya'sone-time service fee. Supporter contributions are governed bySupporter Refunds (Initiated by Supporters)and byChargebacks and Payment Disputesbelow.
Refund Eligibility
Due to the nature of our service, donaya does not offer refunds for change of heart/mind purchases or any other reason. All sales are final, and no refunds will be provided for any reason whatsoever. TheService Fee is non-refundable, even if the contribution is partially refunded or reversed.
User Responsibility
By using donaya, you agree to take full responsibility for your purchases and to perform your own due diligence before making a purchase. It is up to the user to ensure that they understand the terms and conditions of our service and that they have read our FAQ section before making a purchase.
No Obligation to Refund
donaya is a one-time purchase platform for organization websites, catalogs, events, and supporter payments. We do not have an obligation to provide refunds, and we reserve the right to refuse any refund request. By using our service, you agree that you will not dispute any charges made to your credit card for your donaya purchase.
Platform Fee Guarantee
donaya offers a one-time purchase guarantee. If the total contributions received through your donaya catalog are less than the one-time service fee you paid, donaya will refund the difference between the service fee and the total contributions received (the “Platform Fee Guarantee”).
Conditions of the Platform Fee Guarantee:
1. The Platform Fee Guarantee applies only to the initial one-time service fee paid directly to donaya.
2. “Total contributions received” means the gross value of valid, completed transactions made to your catalog through donaya, excluding failed payments, chargebacks, reversals, refunds to contributors, and any transactions identified as fraudulent or abusive.
3. The catalog must remain active and in good standing for at least 90 days from purchase, with accurate account and payout details provided and verified. The Guarantee does not apply if the account is closed, suspended, or cancelled during this period.
4. Any payment under the Platform Fee Guarantee will be issued only to the original payment method used for the one-time service fee and will not exceed the amount of that fee minus the total contributions received.
5. The Platform Fee Guarantee does not cover any additional services, add-ons, third-party fees, chargeback fees, currency conversion costs, or payout/processing fees.
6. donaya may request documentation or undertake reasonable checks to verify contributions and prevent misuse. donaya may decline or delay a Guarantee payment where fraud, abuse, or ineligibility is suspected.
Limitation of Liability:The Platform Fee Guarantee is donaya's sole and exclusive refund obligation. To the maximum extent permitted by law, donaya's total liability in connection with the Guarantee shall not exceed the amount of the one-time service fee paid, less any contributions actually received. The Guarantee is offered globally, subject to applicable local law and any mandatory consumer rights.
Cancellation Policy
If you need to cancel your account, please contact us immediately. We will do our best to assist you, but please note that we do not offer refunds for any reason, including cancellation.
By using donaya, you acknowledge that you have read, understood, and agreed to our refund policy. donaya reserves the right to update or modify our refund policy at any time without prior notice.
Supporter Refunds (Initiated by Supporters)
- Scope.This section applies toGuest contributions. It does not apply to the donaya one-time service fee (which remains non-refundable, as set out above).
- When We May Refund.If a Guest requests a refund, donaya may (but is not obligated to) process the refund on your behalf where: (a) required by applicable law or card-network rules; (b) the contribution was clearly made in error (e.g., duplicate charge); (c) you instruct us to refund; or (d) donaya determines a refund is appropriate to prevent or resolve a dispute.
- Fees Are Non-Refundable.Refunds to supporters are processednet of non-refundable processing fees, FX costs, dispute/handling fees, and any other third-party chargesalready incurred. You authorize donaya to deduct such amounts from your balance or future payouts.
- Your Responsibility.You are responsible for all refunded amounts and associated fees. If your balance is insufficient, you authorize donaya to offset against future payouts or invoice you for the shortfall.
- Timing & Method.Refunds are issued to the original payment method where technically feasible. Processing times vary by bank and region.
- Consumer Rights.Nothing in this section limits any non-excludable consumer rights or remedies that may apply under mandatory law.
Taxation Responsibilities
donaya is a platform for organization websites, catalogs, events, and supporter payments and does not provide tax, legal, or financial advice. Each organization is solely responsible for understanding its own tax, compliance, reporting, and financial obligations, including any implications related to donations, sales, or other contributions received through the platform. donaya does not warrant or guarantee the accuracy or completeness of any tax-related information provided on the platform.
Further, donaya is not responsible for issuing any tax forms, including but not limited to Form 1099-K, to organizations, supporters, customers, or other contributors except to the extent required by applicable law. If donaya is legally required to issue a tax form, it will do so only as required by law. However, donaya does not assume responsibility or liability for the accuracy, timeliness, or completeness of any tax forms issued, and each organization is solely responsible for reviewing and verifying the accuracy of any tax forms received.
Organizations are strongly advised to consult qualified tax, legal, and financial professionals to determine their specific obligations, including reporting, record-keeping, sales treatment, charitable compliance, and payment of any taxes owed. donaya is not liable for any tax liabilities, penalties, interest, or other consequences incurred by organizations, supporters, customers, or other contributors arising from the use of the platform or any donations, sales, or other contributions received through the platform.
By using donaya, organizations, supporters, customers, and other contributors acknowledge and agree that they are solely responsible for their own tax and compliance obligations and that donaya has no liability or responsibility in connection with them.
Third-Party Providers and Payment Processing
donaya does not operate as a trustee, fiduciary, escrow agent, or financial intermediary for users or any parties involved.
We engage trusted third parties to facilitate payments and identity verification. These include:
- Airwallex— For global money transfers and FX services.
- Persona— For verification, identity, and KYC services.
- PayEngine— Our transaction processing gateway.
By using donaya, you agree to be bound by their respective terms of service, privacy policies, and fees, all available on their websites.
Fraud Prevention and Transaction Risk Screening
Definitions. “Organization” means the donaya account holder receiving contributions. “Supporter” means a payer making a contribution. “We,” “us,” and “donaya” include our affiliates and payment processing partners.
- Screening of Transactions.
We (and our payment processors) may screen all card transactions using industry-standard fraud prevention tools. These checks help detect unusual or high-risk activity and are performed to protect organizations and supporters from fraudulent use of payment cards.
- Temporary Holds, Declines, and Verification.
If our systems flag a transaction as high risk, we may delay settlement, decline the transaction, or request additional verification from the supporter and/or organization (for example, retrying with another card or method). Screening outcomes may occasionally result in the rejection of legitimate transactions; this is an inherent limitation of fraud prevention technologies.
- Chargebacks and Liability.
In the event of a chargeback or dispute, the disputed amount may be debited from the organization's donaya balance or future payouts. We may pass through dispute, retrieval, and processing fees assessed by card networks or payment processors. Organizations are responsible for amounts owed arising from chargebacks, reversals, or refunds.
- Compliance.
donaya operates in accordance with applicable card-network rules, anti-money laundering (AML) obligations, sanctions and financial crime screening requirements, and other laws in the jurisdictions where we operate. By using donaya, you authorize these checks and acknowledge that screening may delay or prevent a contribution from being processed.
- User Responsibilities.
Organizations must ensure contributions are from known and legitimate sources and must promptly respond to any verification requests. donaya is not responsible for losses resulting from fraudulent activity, declined transactions, or delays where we or our processors have acted in accordance with fraud-prevention protocols and applicable rules.
- Prohibited or Suspicious Activity.
We may suspend or terminate access, freeze or withhold payouts, or notify relevant authorities if we suspect prohibited or unlawful activity, or if required to comply with legal or card-network obligations.
Note:This section supplements any existing payment, disputes, and acceptable-use terms and will prevail to the extent of inconsistency.
Enhanced Verification & Ongoing Monitoring
donaya may, at account setup and at any time thereafter, require enhanced verification from organizations, including but not limited to government-issued identification, proof of address, beneficial-owner details, source-of-funds/source-of-wealth information, and/or additional documentation reasonably requested by donaya or its payment partners. donaya may also conduct ongoing monitoring and periodic re-verification. Failure to complete requested verification to donaya's satisfaction may result in suspension, limits on account functionality, delayed or withheld payouts, or termination. To the extent permitted by law, donaya may rely on third-party providers to perform these checks on its behalf.
Data Handling and Compliance
donaya may collect and share limited personal data (such as identity verification info and payment details) with our third-party providers solely for the purposes of fraud prevention, payment processing, and account verification. All data is handled in accordance with our Privacy Policy.
Chargebacks and Payment Disputes
If a supporter initiates a dispute or chargeback with their bank or payment provider relating to a contribution made through donaya, donaya reserves the right to pause or withhold payouts to the organization until the dispute is resolved. This may include freezing balances in the organization's account or withholding future payouts.
Each chargeback or dispute is subject to a non-refundable dispute handling fee ofUSD $50 (or equivalent in local currency). This fee will be deducted from the organization's balance to cover administrative and processing costs incurred by donaya.
If a chargeback or dispute is resolved in favor of the supporter, the disputed funds, together with the dispute handling fee, will be deducted from the organization's donaya account balance. If sufficient funds are not available in the balance, donaya reserves the right to recover the outstanding amount by offsetting against future payouts or by invoicing the organization directly.
By using donaya, organizations acknowledge and agree that contributions received may be subject to chargebacks, reversals, or disputes initiated by supporters, and that donaya shall not be liable for any shortfall in funds resulting from such disputes. Organizations accept full financial responsibility for chargebacks relating to their catalog.
Payouts, Reserves & Settlement Delays
- Managed Payouts for High-Risk Accounts.If donaya (or its payment partners) determines in its discretion that an account presents elevated risk (e.g., unusual activity, high dispute rates, incomplete verification), donaya may place the account onmanaged payouts, meaning donaya will initiate payouts on your behalf on a schedule it deems appropriate.
- Reserves / Holds.donaya may establish a reserve and/or hold a portion or all of your available balance for up to45 days(or longer if reasonably required to comply with card-network rules, AML/CTF obligations, or law) to cover potential chargebacks, reversals, refunds, or other liabilities.
- Release of Funds.Held funds will be released when donaya reasonably determines that the risk period has passed. donaya may apply held funds to satisfy any amounts you owe to donaya, its payment partners, or supporters (including dispute-handling fees, chargebacks, or refunds).
- No Interest.Reserves and held funds do not accrue interest for your benefit.
- Communication.Where practicable, donaya will notify you if your account is placed on managed payouts or subject to a reserve/hold and may request additional information to reassess risk.
Liability Disclaimer
donaya acts solely as a facilitator for organizations to create and manage their public pages, catalogs, events, and supporter payment flows. donaya does not provide the underlying goods, services, donations, or campaigns offered by organizations and does not have control over or responsibility for the actions or omissions of organizations or third-party payment processors, such as Stripe (https://www.stripe.com).
Organizations understand and acknowledge that donaya is not responsible for any transactions or interactions between organizations and supporters, including the collection, management, or distribution of donations, sales proceeds, or other contributions. donaya does not assume liability or responsibility for disputes, issues, losses, damages, or liabilities arising from or related to the use of the platform or any transactions between organizations and supporters.
Organizations and supporters agree that any disputes, issues, or claims arising from or related to the use of the platform, including donations, sales, contributions, or any associated tax implications, shall be solely between the parties involved, and donaya shall not have any liability or responsibility in connection therewith. donaya encourages organizations and supporters to seek independent legal, financial, or tax advice as needed and to resolve any disputes or issues directly among themselves or with the relevant third-party payment processors.
By using donaya, organizations and supporters acknowledge and agree that donaya is not responsible for any actions or omissions of organizations, supporters, or third-party payment processors, and that donaya shall not have any liability or responsibility in connection therewith.
donaya does not assume any liability or responsibility for donations, sales proceeds, or other contributions collected by organizations through third-party payment methods, including but not limited to PayPal, Venmo, Cash App, Zelle, Revolut, Bitcoin, Wise, or other external payment processors. donaya is not responsible for the actions or omissions of third-party payment processors, and any disputes, issues, or claims arising from or related to the use of third-party payment methods shall be solely between the organization and the relevant payment processors.
Organizations using donaya to collect donations, sales proceeds, or other contributions through third-party payment methods acknowledge and agree that donaya does not have control over or responsibility for the transactions, interactions, or outcomes related to such third-party payment methods. donaya encourages organizations to comply with the terms and conditions, policies, and guidelines of any third-party payment processors they choose to use, and to seek independent legal, financial, or tax advice as needed.
donaya shall not have any liability or responsibility for any disputes, issues, losses, damages, or liabilities arising from or related to the use of third-party payment methods by organizations, including any tax liabilities, penalties, or consequences. Organizations and supporters agree to resolve disputes or issues related to third-party payment methods directly with the relevant payment processors, and donaya shall not be liable for any actions or omissions of such payment processors.
Catalog Removal and Liability
Please be aware that if, for any reason, your catalog becomes unpublished, donaya will not be held liable for any loss of contributions or potential donations. It is the user's responsibility to ensure the correct functioning and status of their catalog.
Furthermore, donaya makes no warranties, expressed or implied, as to the uninterrupted or error-free operation of its services, the accuracy or completeness of its content, or the correctness of its users' actions.
donaya reserves the right to modify, suspend, or discontinue any part of its services at any time without notice, and shall not be liable for any such changes.
By using donaya's services, you agree to indemnify and hold harmless donaya, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees) resulting from or arising out of your use and access of the services.
iFrames
Without prior approval and express written permission, you may not create frames around our Web pages or use other techniques that alter in any way the visual presentation or appearance of our Web site.
Reservation of Rights
We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our Web site. You agree to immediately remove all links to our Web site upon such request. We also reserve the right to amend these terms and conditions and its linking policy at any time. You acknowledge that you have the legal right to use and display all of that content and that you have obtained all necessary permissions, licenses, and releases from third parties who own or have rights to it.
donaya does not take responsibility for any infringement of copyright or other intellectual property laws arising from the content you upload or use on your public pages or catalog. By using our service, you agree to indemnify and hold donaya and its affiliates, officers, agents, and employees harmless from any claim, demand, or damage, including reasonable attorneys' fees, arising from or related to your use of that content.
You acknowledge that you have read, understood, and agreed to this clause and that donaya reserves the right to remove any content that violates this policy without prior notice.
Infringement Claims Policy
If you are a copyright owner or an agent thereof and believe that any content on our website infringes upon your copyright, you may submit a written notice of infringement to our designated agent atcontacto@donaya.es. To be effective, the notice must include the following:
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted;
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

The user would then have the opportunity to submit a counter-notice if they believe that the content was posted in error or without authorization.
Certificates
In certain circumstances, we may need to reject your order, including but not limited to where requested product is not available or if there is an error in the price or the product description posted on the website.
If we reject an order placed through the website, we will endeavor to notify you of that rejection at the time you place the order or within a reasonable time after you submit your order.
Each certificate order we accept forms a separate binding agreement between you and us for the supply of those products. For each accepted order, we will supply the products in that order in accordance with these Terms of Service.
Delivery
After ordering online, you will receive a confirmation. Delivery options and providers may vary by destination and availability. We will show the relevant delivery details before the order is completed.
The shipping fee for your order is included in the certificate bundle price.
You acknowledge and agree that any person at the delivery address who receives the products is authorised by you to receive your order. If no-one is available to collect your order at the time that is delivered, the delivery service will leave written instructions on how you can collect your order from the nearest post office.
Returns and exchanges
Unfortunately, we do not accept returns or exchanges for certificates.

- Statements explicitly soliciting monetary transactions (e.g., "Here's our PayPal username") are prohibited.
3. Moderation and Enforcement
- donaya reserves the right to remove any content that violates these guidelines or negatively impacts the platform's user experience.
- Attempts to bypass these policies through embedded scripts, custom HTML, or other unauthorized methods may result in account action.
donaya websites are crafted to deliver a clear, trustworthy experience for organizations and their supporters. By adhering to these guidelines, you help maintain the integrity and professionalism of the platform.
By creating a website on donaya, you agree to these terms to ensure an exceptional experience for all users.
Force Majeure
donaya shall not be held liable for any delay or failure in performance resulting from acts beyond its reasonable control, including but not limited to natural disasters, internet outages, payment provider failures, or government restrictions.
Indemnification
You agree to indemnify and hold harmless donaya, its directors, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:
- Your use of the platform
